Fifth Circuit Revives Trump-Supporting Student’s Harassment Claim Against Austin ISD

The entire U.S. Fifth Circuit Court of Appeals will reconsider the dismissal by a three-judge Fifth Circuit panel of a lawsuit filed by a former Austin ISD student who claimed AISD students and staff harassed him due to his race (White), religion (Christianity) and political beliefs (fervent support of then President Donald Trump and the Republican Party).

The Fifth Circuit announced (June 27) that the prior decision has been vacated, and the appeal will be considered “en banc” by the circuit’s 16 active judges.

Oral arguments will be scheduled at a later date, the announcement states.
