The Department of State Health Services (DSHS) has posted a proposed rule revision (for public comment) to implement SB294/regular session legislation relating to asthma medications in schools.

The proposed rule revision, firstly, replaces all references to “asthma” to “respiratory distress.”

For example, the current title of the rule (Maintenance and Administration of Asthma Medication) is being changed to Maintenance and Administration of Medication for Respiratory Distress.

The proposed rule revision also implements a SB294 provision that is designed to increase the pool of trained persons (including staff and volunteers) who are authorized to administer respiratory distress medications in school settings.

Numerous other changes are proposed.

The stated public comment deadline is 31 days after posting in the Friday, Nov. 15 Texas Register.
