Keller ISD’s Proposed Split into Two Districts Draws Request for AG’s Opinion
The well reported (and highly controversial) proposal to split Keller ISD into two districts has resulted in a request for a state attorney general’s opinion.
Tarrant County Criminal District Attorney Phil Sorrells asked these two questions in his request (RQ-0580-KP):
- Can a school board for a single school district pass a resolution detaching a portion of its territory and create a new school district without an election? (Tarrant County officials are adamant that voters should be allowed to decide the final fate of any proposal to split the district, as reported here).
- If a new school district is created through the detachment process, does the Texas Education Code require a county commissioners court to equitably allocate personal property between the previously existing and newly created districts?
The attorney general typically takes up to six months to issue an opinion, but has been known to issue opinions quicker.
