Texas Supreme Court Accepts Appeal Pitting Two Ex-Board Members Against Webb CISD

The Texas Supreme Court (TSC) on Friday (May 30, 2025) announced it has agreed to consider if two former Webb CISD (WCISD) school board members — who are married to each other — can pursue attorney and court fees from the ISD after their lawsuit against the district was dismissed as “moot.”

Background

Robert and Amy Marshall were both WCISD board members when they sued the district in June 2020 on a claim that the ISD had not provided them with all the information they had requested pursuant to Texas Education Code §11.1512(c). That’s the state law that gives school board members — without having to first file a Public Information Act request — the “inherent right” to receive information, records and other documents that they requested from their school district.
