U.S. Supreme Court Ends Ex-Austin ISD MAGA Student’s Appeal

The U.S. Supreme Court today (Monday, June 30, 2025) refused to revive a lawsuit dismissed by lower courts in which a now-former Austin ISD student claimed he was verbally and physically bullied by students — and verbally harassed by school staff — due to his being a fervent White/Christian/Trump/MAGA supporter.
The parents of former student “B.W.” sued AISD, and appealed to the Fifth Circuit after the federal trial judge dismissed their lawsuit.
A three-judge Fifth Circuit panel, via a 2-1 margin, upheld dismissal (article). The entire Fifth Circuit then reconsidered, resulting in the dismissal standing due to the justices being “evenly divided” (article), which subsequent records revealed to be a 9-9 split.
A further appeal to the U.S. Supreme Court resulted in today’s announcement that the nation’s top court would not consider the appeal.
