Paxton: School Trustees Can Simultaneously Serve as Justices of the Peace

A person can serve as a Texas school board member and a justice of the peace at the same time, Texas Attorney General Ken Paxton says in AG Opinion No. KP-0529 issued Wednesday (Sept. 16, 2026).

Paxton also ruled that a school board member doesn’t have to resign upon announcing he or she is running for justice of the peace.

The question was asked by the Texas House Public Education Committee.
