Ruling: A school bus dealership and a school bus manufacturer can’t have the lawsuit that the parents of a student killed in a school bus related accident filed against them moved from Dallas County.

Background

This unanimous Texas Supreme Court (TSC) ruling revolves around where the remaining portion of a lawsuit that the parents of a 6-year-old Brock ISD student — who was killed in an April 25, 2022, school bus accident — should be litigated.

  • Note: Court records and media reports allege that BISD elementary student Emory Sayre had gotten off the bus near her home with several other children. Because her home was on the other side of the street, she had to cross in front of the bus to get home. As she began crossing the street, the driver started pulling away — with Emory directly in the path of the bus. The bus struck the girl, where she was run over by the front and rear tires. The bus driver was not criminally charged.
