TEA Rules Update
Commissioner of education (TEA) rule actions that were posted in the July 19 Texas Register:
Proposed Rules
Comments are being accepted through August 19 (via this form) for each of these proposed rules to implement recent legislation:
- Special-ed graduation requirements — Addressing (for special-ed students):
- Graduation requirements.
- The use of restraints and time outs.
- How the law prohibiting (except in specified circumstances) peace officers/school security officers from tasing (or using a chemical irritant against) a student in grade 5 or below applies to special-ed students. (The TEA says this part of the rule could be subject to future revisions, based on communications with stakeholders.)
- DAEP/safe schools — Defining violent conduct for the purpose of a student’s placement into a disciplinary alternative education program (DAEP) when the program is at capacity.
- School personnel mental health training — Implementing mental health training requirements for specified school personnel.
Adopted Rule
- Special education — Establishing requirements for extended school year (ESY) services for special education students. No changes from the version previously proposed for public comment. Effective: July 22.
